1. Acceptance of Terms
By accessing, registering with, or utilizing drainlogic.org, mobile applications, or any dispatch, rental listing, and subcontracting services provided by DrainLogic (collectively, the "Platform"), you ("User," "Property Manager," "Subcontractor," "Technician," or "Tenant") agree to be bound by these Terms of Service. If you do not agree to every clause, you must immediately cease all use of the Platform.
2. Scope of Operations & Jurisdiction
DrainLogic is a technology-enabled dispatch, property management, and subcontractor coordination platform headquartered in Milwaukee, Wisconsin. While our operational infrastructure supports users, property portfolios, and independent trade networks across all 50 United States, all transactions, platform usage, and disputes are expressly subject to the exclusive jurisdiction and governing laws of the State of Wisconsin, without regard to conflict of law principles.
3. Nature of Platform & Non-Emergency Disclaimer
Platform Role: DrainLogic acts exclusively as a software and administrative intermediary connecting property owners, managers, and tenants with independent third-party subcontractors, trades professionals, and internal technicians. DrainLogic is not a general contractor, property owner, or direct employer of all independent subcontractors utilized on the network unless explicitly designated.
Not an Emergency Service: DrainLogic is not an emergency response service. For critical hazards, structural collapses, major gas leaks, or life-threatening emergencies, Users must immediately dial 911 or contact their local utility provider.
4. Subcontractor & Vendor Terms
Independent Status: Subcontractors and technicians operating through DrainLogic are independent business entities or independent contractors, not agents, employees, or partners of DrainLogic.
Licensing & Compliance: Subcontractors represent and warrant that they maintain all necessary state, county, and municipal licenses, permits, and professional insurance required to perform trade services in their respective service areas across all 50 states.
Indemnification of Platform: Subcontractors assume full liability for their work product, job-site safety, code compliance, and property damage. Subcontractors agree to indemnify, defend, and hold harmless DrainLogic, its officers, directors, and affiliates from any claims arising out of their workmanship or job-site actions.
5. Rental Listings & Property Subcontracting
Listing Accuracy: Property managers and owners posting rental listings or maintenance requirements warrant that all details, pricing, availability, and property conditions are accurate and comply with all applicable local, state, and federal fair housing laws (including the Federal Fair Housing Act).
Right to Remove: DrainLogic maintains absolute discretion to remove any rental listing, suspend accounts, or terminate dispatch privileges for violations of safety standards, fraudulent postings, or policy breaches.
6. Limitation of Liability
To the maximum extent permitted by applicable law, DrainLogic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or goodwill, arising out of or in connection with Platform usage, subcontractor workmanship, or property rental transactions. Total cumulative liability of DrainLogic for any claim arising under these terms shall not exceed the total fees paid by the User to DrainLogic in the preceding six (6) months, or one hundred dollars ($100), whichever is greater.
